Neither pmjohnsonequipment.com nor any providers of information shall have any liability for the accuracy of the information contained in the service, or the contents of any advertisements, or for assertions or omissions therein. No party shall be liable to any other party or any third-party for third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. In no case shall Pmjohnsonequipment.com be liable for any costs or events that occur beyond its control including, but not limited to, network outages, Internet connectivity problems and client side browser issues.

You, as an individual equipment seller, are entirely responsible and liable for all of your postings to Pmjohnsonequipment.com. Listed below are some, though not all, violations that may result in Pmjohnsonequipment.com deleting your postings. You agree not to do any of the following requests while listing an ad on Pmjohnsonequipment.com:
 


- Harass, threaten, embarrass or slander any person or entity; 


- Transmit via Pmjohnsonequipment.com any information, data, text, files, links, software, chat, communication or other materials ("Content") that  Pmjohnsonequipment.com considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable; 


- Impersonate in Pmjohnsonequipment.com any business or person, living or dead, famous or not; 


- Intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing Pmjohnsonequipment.com or in connection with your use of Pmjohnsonequipment.com in any manner.

The price and other terms of any sale remain subject to direct negotiation between the buyer and the seller. The prices listed by sellers on Pmjohnsonequipment.com often exclude sales tax, finance charges, title, license, regulatory, dealer documentary, emission testing, compliance fees, and other related charges, any or all of which may be added to the listed price to arrive at the final sale price of a piece of Equipment. Pmjohnsonequipment.com shall not be responsible for any Content. Pmjohnsonequipment.com does not prescreen or monitor all Content as a matter of policy, but Pmjohnsonequipment.com shall have the right, but not the responsibility, to remove Content which is deemed in sole discretion harmful, offensive, or otherwise in violation of this Agreement or any rules Pmjohnsonequipment.com has in place at the time. When you offer a piece of Equipment through Pmjohnsonequipment.com, you must be prepared to sell that Equipment at the price at which, and the terms on which, you've listed it. You must have the ability to transfer title or ownership. To list a piece of Equipment on Pmjohnsonequipment.com, sellers are required to provide certain identifying and contact information. The information must accurately identify the seller and the method of contact must permit buyers to communicate directly with the seller. You may not charge any potential buyer for information about any Equipment listed for sale on Pmjohnsonequipment.com. Pmjohnsonequipment.com reserves the right to deny use of this website to anyone who does not comply with these requirements or who otherwise uses our website in a manner we consider inappropriate.

LINKS TO OTHER SITES

BILLING FOR LISTING SERVICES

By purchasing any of the PER MONTH Equipment advertising packages offered by Pmjohnsonequipment.com you agree that after the first month of advertising, the Credit Card on file is automatically billed monthly unless you discontinue automatic monthly billing. To discontinue automatic monthly billing mark your Equipment for sale as SOLD, click CANCEL AD, or call us directly @ 1-541-610-3900. You may also E-MAIL us at sales<at>pmjohnsonequipment<dot>com but we cannot guarantee your advertisement(s) will be cancelled via this method.

By submitting a listing through Pmjohnsonequipment.com, you agree to pay the fees specified for the advertising package you select, regardless of whether your Equipment sells as a result of the listing(s). Listing fees are not refundable and in order to sell your Equipment, we highly recommend asking a fair price, adding pictures and supplying users with as much current and accurate information as possible.

COMMUNICATIONS

By becoming and remaining a listing seller, you are acquiescing to any and all future changes to these Sites' official policies. All sellers agree to receive future communications of changes and/or updates to these Sites via e-mail, as well as additional communications on products, services, and featured offers. Offers made on behalf of our selected partners will have an opt-out option for receiving future communications to ensure compliance with the CAN-SPAM Act of 2003 and any other applicable federal and/or state laws. Visitors to the Sites who are not listing sellers of the Sites are expressly bound by the Terms of Use and all notices on the Sites, thereof, by their mere use of the Sites.

We also provide Internet advertising (listing services) to Heavy Equipment owners who want to sell their Equipment by owner. Our listing service is provided on a commission-free basis and helps to link buyers and sellers together.  Pmjohnsonequipment.com shall not be held liable for any misleading or fraudulent information placed into the database by Equipment owners. Descriptions are provided by the owners and must be verified by potential purchasers.
